Scope area

FLAT & BOUND sells vintage posters and antiquarian books and guarantees the authenticity of the artworks. Please read these terms and conditions carefully as they apply to your orders. By confirming "I agree to Integral Lars Müller Terms & Conditions" at the opening of an order you accept the present Terms and Conditions. If you have any questions, suggestions or critique, please send your inquiry to info@flatandbound.com.

Orders and inquiries

Please send inquiries by e-mail and orders through the webshop. The availability of the desired product is subject to alterations at any time. When you place an order, we send you an email with a receipt confirming your order and listing the details including the shipping costs and all relevant related fees. In providing the goods for dispatch or by deliveries of the goods by FLAT & BOUND the sales contract is regarded as closed.

Shipping and customs

The goods are properly packaged and shipped by courier from Switzerland to customers all over the world. Orders will be delivered worldwide within two weeks. Shipping costs, customs duties and import taxes such as the VAT are at the expense of the buyer. All items are insured by Integral Lars Müller GmbH until delivery. Should the delivery be delayed or the goods seem damaged, please contact us through info@flatandbound.com. Please do not return goods unsolicited.

Terms of payment

Customer deliveries occur only upon advanced payment, which can be done by credit card. If the payment options are not sufficient for your needs, please contact us through info@flatandbound.com.

Liability, shipping and insurance

All details and descriptions of the posters and books are published as accurately as possible and to the best of our knowledge. We cannot be held responsible for omissions, inaccuracies and errors in condition reports.

Poster description

The internationally valid codes listed below are used to describe the condition of the posters:

  • A Excellent condition. Possibly one minor defect.
  • A- Good condition with minor defects restricted to the margins: color abrasions, creases, scratches, small tears, spots.
  • B Fair condition with clear defects, possibly restored: creases, tears, spots, missing pieces, folding.
  • C Missing important parts, often restoredestored.

Photographs on the website

The size, quality, colour and definition of the artworks published by Flat & Bound on its website may differ depending on screen settings, software or other factors. On request we are happy to supply you with photos in higher resolution, together with a detailed description of the condition.

This privacy statement informs you about the personal data we collect in connection with our activities and operations, including our website https://www.flatandbound.com. In particular, we inform for which purpose, how and where we process personal data. We also inform you about the rights of persons whose data we process. For individual or additional operations and activities, further data protection declarations and other legal documents such as the General Terms and Conditions (GTC), Terms of Use or Conditions of Participation may apply.

We are subject to Swiss data protection law and any applicable foreign data protection law, in particular that of the European Union (EU) and its General Data Protection Regulation (GDPR). The European Commission recognizes that Swiss data protection law ensures an adequate level of data protection.

Terms and legal bases on processing personal data

Personal data includes all information that relates to a specific or identifiable person. "A person concerned" is a person about whom personal data is processed.
"Processing" includes any handling of personal data, regardless of the means and procedures used, in particular the storage, disclosure, acquisition, collection, deletion, storage, modification, destruction and use of personal data.

The European Economic Area (EEA) comprises the member states of the European Union (EU) as well as the Principality of Liechtenstein, Iceland and Norway. The General Data Protection Regulation (GDPR) refers to the processing of personal data. We process personal data in accordance with the Swiss Data Protection Law, in particular the new Data Protection Law (nDSG) and the Ordinance to the Swiss Federal Law on Data Protection (VDSG).

We process - if and to the extent that the GDPR applies - personal data in accordance with at least one of the following legal bases:

Art. 6 para. 1 lit. b DSGVO for the necessary processing of personal data to fulfill a contract with a person concerned as well as for the implementation of pre-contractual measures.

Art. 6 para. 1 lit. f DSGVO for the necessary processing of personal data in order to protect the legitimate interests of us or of third parties, provided that the fundamental freedoms and and fundamental rights and interests of the person concerned prevail. Legitimate interests are, in particular, our interest to carry out our activities and operations in a durable, user-friendly, secure and reliable manner, as well as to be able to communicate about them, the guarantee of information security, protection against misuse, enforcement of our own legal claims, and compliance with Swiss law.

Art. 6 para. 1 lit. c DSGVO for the necessary processing of personal data to fulfill a legal obligation to which we are subject under any applicable law of member states in the European Economic Area (EEA).

Art. 6 para. 1 lit. e DSGVO for the necessary processing of personal data for the performance of a task that is in the public interest.

Art. 6 para. 1 lit. a DSGVO for the processing of personal data with the consent of the person concerned.

Art. 6 para. 1 lit. d DSGVO for the necessary processing of personal data to protect vital interests of the person concerned or another natural person.

Type, scope and purpose on processing personal data

We process the personal data that is necessary to carry out our activities and operations in a durable, user-friendly, secure and reliable manner. Such personal data can be divided into the categories of inventory and contact data, browser and device data, content data, meta data and usage data, location data, sales data as well as contract and payment data.

We process personal data for the duration required for the respective purpose(s) or as required by law. Personal data whose processing is no longer required will be anonymized or deleted.

We may have personal data processed by third parties. We may process personal data together with third parties or transmit it to third parties. Such third parties are in particular specialized providers whose services we use. We guarantee data protection for such third parties as well.

We process personal data only with the consent of the person concerned, unless the processing is permitted for other legal reasons. Processing without consent may be permissible, for example, for the performance of a contract with the data subject and for corresponding pre-contractual measures, in order to protect our overriding legitimate interests, because the processing is evident from the circumstances or after prior information.

In this context, we process in particular information that a data subject provides when contacting us – i.e. by letter, e-mail, instant messaging, contact form, social media or telephone. We may store such information, for example, in an address book, in a Customer Relationship Management System (CRM-System) or with comparable tools. If we receive data about other persons, the transmitting persons are obligated to observe the data protection with respect to these persons as well as to ensure the accuracy of this personal data.

We also process personal data that we receive from third parties, obtain from publicly accessible sources or collect in the course of our activities and operations, if and to the extent that such processing is permitted.

Digital Infrastructure

We use the services of specialized third parties to make use of the digital infrastructure required in connection with our activities and operations. These include hosting and storage services from selected providers (we use in particular: Hostpoint).

Data collected while using our webshop

When ordering through our web shop, the following data is collected and saved:

  • Last name / first name
  • Address
  • Postcode / place
  • Email address
  • Phone number (optional, if provided)

Last name, first name, address, postcode, place and e-mail address will be passed on to our distribution partners and courier services in order to facilitate the order. Integral Lars Müller GmbH will use the email address and, if provided, the phone number for requests on orders or deliveries. All data collected in the context of your order is stored in our local database for accounting purposes.

For credit card payments we use the services of third party provider Stripe Inc (stripe.com). Data collected for the purpose of processing payments will not be stored by Integral Lars Müller GmbH.

Data collected while using our website

Cookies

We use cookies for the operation of this website. Cookies – both our own (first party cookies) and cookies from third parties whose services we use (third party cookies) – are data that is stored in the browser. Such stored data need not be limited to traditional cookies in text form.

Cookies can be stored in a browser temporarily as "session cookies" or for a certain period of time as so-called "permanent" cookies. Session cookies are automatically deleted when the browser is closed. Permanent cookies have a certain storage period. Cookies make it possible, for example, to recognize a browser the next time our website is visited. Thus we can measure the reach of our website. Tracking Pixels

We may use tracking pixels on our website. Tracking pixels are also referred to as web beacons. Tracking pixels - also from third parties whose services we use - are small, usually invisible images that are automatically retrieved when you visit our website. With pixel counters, the same information can be collected as in server log files.

We store such information, which may also constitute personal data, in server log files. The information is required to provide our website permanently, user-friendly and reliable, as well as to ensure data security and thus in particular the protection of personal data - also by third parties or with the help of third parties.

We are not responsible for the content of external websites to which we provide links. For illegal, erroneous or incomplete content and in particular for damages resulting from using or not using such information, only the provider of the linked pages is liable towards you. Under no circumstances can we be held liable for damages and consequential damages of any kind resulting from the use of those pages.

Subscribing to our Newsletter

If you have subscribed to our newsletter, we use the contact details you have supplied for sending you information on products and services provided by Integral Lars Müller GmbH by email, in particular in the form of regular newsletters. The newsletters are sent with the help of specialized service providers (we use in particular: Mailchimp).

You can revoke your permission to send you these newsletters at any time by clicking the “unsubscribe” link in one of our emails. Data is thus processed with your consent, pursuant to art. 6 paragraph 1a GDPR.

Social Media

We are present on social media platforms and other online platforms to communicate with interested parties and to provide information about our activities and operations. In connection with such platforms, personal data may also be processed outside of Switzerland and the European Economic Area (EEA).

In each case, the general terms and conditions (GTC) and terms of use as well as data protection declarations and other provisions of the individual operators of such platforms also apply. These provisions inform in particular about the rights of persons concerned directly against the respective platform, which includes, for example, the right to information.

For our social media presence on Facebook including the so-called "page insights" we are - if and insofar as the General Data Protection Regulation (GDPR) is applicable - jointly responsible with Meta Platforms Ireland Limited (Ireland). Meta Platforms Ireland Limited is part of the Meta companies (operative in the USA among others). The page insights provide information about how visitors interact with our Facebook presence. We use page insights to provide our social media presence on Facebook in an effective and user-friendly manner.

Further information on the nature, scope and purpose of data processing, information on the rights of persons concerned, as well as the contact details of Facebook and the data protection officer of Facebook can be found in Facebook's privacy policy. We have entered into the so-called "Responsible Party Addendum" with Facebook and have thereby agreed in particular that Facebook is responsible for ensuring the rights of persons concerned. For the so-called page insights, the corresponding information can be found on the page "Page Insights Information" including "Page Insights Data Information".

Targeted advertisement

We use the option of displaying targeted advertisements for our activities and operations on third parties such as social media platforms and search engines.

With such advertising, we would particularly like to reach such persons who are already interested in our activities and operations or could be interested in them (remarketing and targeting). For this purpose, we may transmit corresponding data, including personal data, to third parties who enable such advertising. We can also determine whether our advertising is successful, i.e. in particular whether it leads to visits to our website (conversion tracking).

Third parties with whom we advertise and where you are logged in as a user may be able to associate the use of our online offer to your profile there (we use in particular: Facebook Ads).

With such services we can, among other things, embed functions and content in our website. With such services used we record the Internet Protocol (IP) address of users at least temporarily for technically compelling reasons.

For necessary security, statistical, and technical purposes, third parties whose services we use, can aggregate data related to our activities and operations, anonymized or pseudonymized. This concerns, for example, performance or usage data in order to be able to offer the respective service (we use in particular services provided by: Google).

Performance and Reach Measurement

This website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). The information about your use of the website (including your IP address) generated by the "cookie" will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for the operators of the website and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Under no circumstances will Google associate your IP address with any other data held by Google Inc. You may refuse the use of cookies by selecting the appropriate settings in your browser software.

When using services and programs for performance and reach measurement, the Internet Protocol (IP) addresses of individual users must be stored. IP addresses are generally shortened ("IP masking") in order to comply with the principle of data pseudonymization to comply with the principle of data minimization and thus improve the data protection of users.

When using services and programs for the measurement of performance and reach, cookies may be used and user profiles may be created. User profiles include, for example, the pages visited or content viewed on our website, information on the size of the screen or browser window and the - at least approximately - location. The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her for scientific or historical research purposes or statistical purposes pursuant to art. 89 paragraph 1, unless there are compelling reasons for processing the data in the public interest.

Changes to data protection policy

We may amend and supplement this privacy policy at any time. We will inform about such adjustments and additions in an appropriate form, in particular by publishing the respective current data protection declaration on our website.
